This agreement is between above owner of above horse and Sharrway Farm . The owner of above horse, hereafter known as OWNER, agrees to pay Sharrway Farm hereafter known as SHIPPER, the amount of__________ for moving the aforementioned horse from ________________
to __________________ (pickup/delivery directions below).
Payment:
· Half of the total due is payable at the time of booking, unless using a credit card.. The other half shall be paid to the SHIPPER at the time of the delivery of the horse to its destination site, in the form of cash, cashiers check, Visa or Master Card, if booking with a Credit Card full payment will be charged to card. Unless other arrangements are made at booking. No personal checks will be accepted at any time including for the deposit.
· Should the owner be unable to provide the shipper with said funds, the shipper will retain custody of the horse until such time as the owner produces payment in full. The owner is subject to board fees at the rate of $2.50 per day for the care of the horse, as well as any additional expenses incurred by the shipper.
· Should the owner still be unable to produce the appropriate funds within 24 hours of delivery time, the shipper has the right to retain the horse and to transport the horse back to the shipper’s barn to be boarded until such time as the OWNER can produce the appropriate funds. The OWNER will then be responsible for board on the horse, farrier, and veterinary expenses incurred while boarding, as well as additional charges to bring the horse back to its original destination. The horse will not be released to any other transport company or to the OWNER until the full value of this contract has been paid.
· If full payment is not produced within 30 days, including board, veterinary fees, farrier expenses, etc… the horse will become the property of the SHIPPER. The horse may then be sold and any monies from the sale used to pay the fees owed. Any remaining money from the sale of the horse will be refunded to the owner. If the monies from the sale do not cover the amount owed to the SHIPPER by the OWNER, then the OWNER is still responsible for the difference.
· The OWNER also agrees to pay any expenses that the horse incurs for veterinary care while in transit for injuries and / or illnesses. These will payable at the time the horse is delivered. The SHIPPER is not liable for the death of the horse, or any injuries sustained by the horse while shipping. The SHIPPER strongly recommends that the OWNER carry full liability and major medical / mortality insurance on any horse being shipped. If the OWNER chooses not to do so, he/she assumes full loss of the animal should any loss (death or injury) occur. Sharrway Farm carries physical liability insurance as required by the State of Oklahoma. Further, Sharrway Farm is not responsible for conduct or acts of horses to themselves or each other, nor loss or damage arising from the condition of the animals themselves, or which results from their nature or propensities. Trip insurance, if desired, should be arranged by the customer through his/her insurance agent and/or we will be glad to recommend an agent.
· The OWNER understands that in booking his/her horse, that he/she has reserved a space on the trailer, and that other horses may have been refused this space as a result of this reservation. In as such, should the owner not follow through on the purchase of the horse, or should the seller refuse to release the horse (for non payment of purchase price/board, etc), the OWNER will be held fully responsible for the full value of this contract. The deposit is NON-REFUNDABLE.
· In the event that the horse is ill (a licensed veterinarian advises against shipping), or the horse dies between the time booked to the haul and the pickup date, then the deposit will be credited to an account for the use of the OWNER at any time for any further hauling needs. Documentation must be provided to the SHIPPER by a licensed veterinary.
· A current coggins (within the last 11 months) and health certificate are required for equines to cross many state lines and through agricultural checkpoints. Please make sure your Veterinary checks the various state laws and provides all the necessary information for those states. States like Montana and Oregon require a permit number on the health Certificate. These are to be provided at the pickup site of the horse. The horse will not be put on the trailer until such time as these documents are provided.

Please Note when dealing with LIVE animals, mechanical equipment, and unpredictable weather conditions, delays may occur. In this situation, the OWNER will be provided with all information concerning the delay and a new itinerary as soon as possible. If, however, the OWNER cannot wait until such time as the SHIPPER will be able to resume the haul, and the OWNER chooses to hire another company, etc……then the OWNER will still be fully responsible for the value of this contract. The only exception will be if the OWNER has informed the SHIPPER, at booking, of a date that the horse MUST be picked up by. The SHIPPER may reject this contract, at his/her discretion, if enough time is not allowed for possible delays. In the event that the horse is already on the trailer, and the haul is delayed, the OWNER may hire another hauler, at his/her discretion, however, they will still be fully responsible for the value of this contract.
